Jumeirah One Terms & Conditions

The following Terms and Conditions apply to all Members of the Jumeirah One Programme.  It is the responsibility of all Members to read and understand these terms and conditions in full.  These terms and conditions were last updated in May 2019.

Jumeirah One Terms and Conditions

The terms and conditions set out below, along with the Programme Rules are referred to as the "Terms and Conditions".  The terms and conditions relating to collection and exchange of Points, collection of Tier Points, Tier upgrades, renewals, downgrades and Tier Privileges (the "Programme Rules") are available on www.jumeirahsirius.com. These Terms and Conditions apply to all Members of the Jumeirah One Programme.  It is the responsibility of all Members to read and understand these Terms and Conditions in full. These Terms and Conditions were last updated in May 2019 and supersede and override any previous terms and conditions.

 

General

1.1.The following definitions shall apply:

  • “Active” refers to Members who have had actively used their Membership by collecting or exchanging Jumeirah One Points in the previous two (2) years;
  • "E-certificates" are the vouchers that enable Members to convert Jumeirah One Points for specified goods or services, provided by Jumeirah One Programme or a Partner and are issued by Jumeirah One service advisors or by individuals employed at the respective participating hotels or by the member logging on to the www.jumeirahsirius.com website;
  • “Jumeirah" means Jumeirah International L.L.C., the entity with ultimate responsibility for Jumeirah One, or any other company within the same group of companies;
  • "Jumeirah One", "Jumeirah One Programme" or "Programme" means Jumeirah's recognitions and rewards programme;
  • "Jumeirah One Card" means either the e-card issued to Members or the physical Membership card issued by Jumeirah One to Silver and Gold Tier Members;
  • "Jumeirah One Points" or "Points" are the reward currency earned by using the Jumeirah One Card;
  • "Jumeirah One Bonus Points" or “Bonus Points" are the Points a Silver or Gold Tier Member earns from an eligible spend and any other promotional offers relating to selected Members;
  • "Member" is a person who is a member of the Jumeirah One Programme and "Membership" shall be construed accordingly;
  • "Privileges" are the exclusive amenities and services provided to a Member depending on the Tier Points that Member has earned;
  • "Partner" or "Jumeirah One Partner" is a company or organisation which: (a) accepts E-certificates and Rewards from a Member in exchange for goods or services; and/or (b) allows a Member to earn Jumeirah One Points when they purchase its goods or services;
  • "Rewards" means specified goods or services to be provided by Jumeirah One or a Partner to a member in exchange for Jumeirah One Points;
  • "Tier" means the Membership level of the Jumeirah One Programme;
  • "Tier Points" are the Membership level points earned by using the Jumeirah One Card and shall determine the level of status attained by a Member; and
  • "Website" refers to www.jumeirahsirius.com, a website operated by or on behalf of Jumeirah, where a Member can access details of the Programme and manage their Membership.

1.2. The Jumeirah One Card is issued by, and remains the sole property of, Jumeirah.

1.3. Membership, Points, Tiers, Rewards, E-certificates and Privileges are offered at the sole discretion of Jumeirah. Jumeirah reserves the right to decline to issue or to withdraw the Jumeirah One Card from a Member at any time. Jumeirah further reserves the right to terminate the validity of the Jumeirah One Card, together with the Privileges or other benefits attached thereto, at any time and for any reason (including but not limited to use of the Jumeirah One Programme which Jumeirah, in its sole discretion, deems excessive or unreasonable). The Jumeirah One Card must be returned without delay to Jumeirah when requested. The withholding or termination of Membership may result in the loss of all Points accumulated at the time of such withdrawal or termination.

1.4. Jumeirah One has no predetermined termination date and shall continue until such time as Jumeirah decides to terminate the Programme with or without notice. Members shall have three (3) months from the date on which the Programme termination is announced to continue accumulating Jumeirah One Points (the "Notice Period"). Starting on the date of expiry of the Notice Period, the Member shall have a further six (6) months within which they must convert all Jumeirah One Points they have accumulated into Rewards or E-certificates. Nine (9) months from the date on which the Programme termination is announced, any unredeemed Jumeirah One Points will be cancelled automatically.

1.5. Jumeirah reserves the right to amend, update, change or delete any aspect of the Jumeirah One Programme at any time, including the Terms and Conditions and Programme Rules, Points, Tiers, Tier eligibility, Privileges, Rewards, E-certificates and promotional offers, even if such changes may affect the value of the Points, Rewards or benefits already collected by the Member. It is the responsibility of each Member to remain aware of any such amendments, updates or changes. Jumeirah will publish the latest Terms and Conditions on its website www.jumeirahsirius.com. 1.6. Jumeirah accepts no responsibility or liability for the withdrawal of any hotels from the Jumeirah portfolio and any Partners from the Programme, even though such withdrawal may affect the collection of Points, Tiers and Rewards available to Members.

1.7. Jumeirah will endeavour to advise Members of matters of interest, including notifying them of changes to the Programme, promotions and other offers. However, Jumeirah accepts no liability for requests or correspondence lost or delayed in the postal system or via electronic mail. Without prejudice to clause 1.5 above, Jumeirah is not liable for and reserves the right to correct any errors in pricing, typing or description relating to any aspect of Jumeirah One.

1.8. When a Member telephones a Jumeirah One service advisor, for security reasons the Jumeirah One service advisor will request personal information in order to verify the Member’s identity.

1.9. The Jumeirah One call centre will only deal with the person authorised to operate the Member's account. To authorise someone other than a Member to operate an account, a request must be made either: (i) in writing to the Jumeirah One Centre, PO Box 214159, Dubai, UAE; (ii) by email to sirius@jumeirahsirius.com  or (iii) by telephoning a Jumeirah One service advisor on +971 (0) 4 364 7500.

1.10. The sale, transfer or barter of any Jumeirah One Points, Rewards, E-certificates, Privileges, Tier Points or other Jumeirah One benefits is prohibited.

1.11. In the event of a Jumeirah One Card being disposed of, lost, stolen or damaged, or when there is a change of a Member’s address, the Member must notify Jumeirah One of such an occurrence immediately.

1.12. Any correspondence sent to a Member, whether by post or electronic mail, is based on the information given to Jumeirah One or Jumeirah. All Members are responsible for notifying Jumeirah One either: (i) in writing to the Jumeirah One  Centre, PO Box 214159, Dubai, UAE; (ii) by email to sirius@jumeirahsirius.com; or (iii) by telephoning a Jumeirah One Service Advisor on +971 (0) 4 364 7500 of any change to their contact details. Any failure to notify Jumeirah One of such change may result in a deduction of such number of Points as Jumeirah One, in its sole discretion, deems reasonable to cover any duplication of postage costs (including courier charges) incurred by Jumeirah One or Jumeirah as a result of incorrect contact details. Members can also update their profile details online via the Website. Jumeirah must be notified in writing (to the address set out in paragraph 1.9) of any change to Member’s name and all such legal or other documentation as Jumeirah shall from time to time request to evidence that change should be provided to Jumeirah by the Member.

1.13. The only valid interpretation of the Terms and Conditions shall be that of Jumeirah One or Jumeirah.

1.14. The use of and participation in the Jumeirah One Programme, including, but not limited to, the collection of Jumeirah One Points, E-certificates, Rewards, Privileges, Tier Points or other Jumeirah One benefits may be subject to fees and taxes in the relevant jurisdiction. As a result, Members will be required to pay such fees and taxes as applicable and in accordance with the existing legislation or any similar legislation that may be introduced in the future. Any tax liability, including disclosure, connected with receipt or use of any of the Jumeirah One Programme is the Member’s responsibility.

1.15. All Room Reservations including Jumeirah One Room Redemptions, Jumeirah One Privileges and Jumeirah One offers are subject to Service Charge, Tourism Fee, Municipality Fee and VAT tax at all Jumeirah Hotels, Resorts & Residences located in the UAE.

1.16. A Member who is travelling on business should comply with their employer's travel policy concerning loyalty schemes. Information about a Member’s accrued Jumeirah One Points may be disclosed by Jumeirah to a Member’s employer.

1.17. These Terms and Conditions are governed by the federal laws of the United Arab Emirates and the Emirate of Dubai. In the event of any dispute, Members agree to submit to the exclusive jurisdiction of the courts of the Emirate of Dubai.

1.18. The Jumeirah One Programme, (including Tier Points, E-certificates, Rewards, Privileges and any other goods and services given to Members) is provided to the extent permissible by any applicable law without any warranties or guarantees, including implied warranties of satisfactory quality or fitness for a particular purpose.  To the extent permissible by any applicable law, Jumeirah excludes all liability and responsibility for itself and its affiliates, Partners and agents for loss or damage (including but not limited to cancellation or delay or loss or misuse of a Member's Jumeirah One Card) of whatever nature (including but not limited to loss of profits or anticipated savings, wasted expenditure or attorney's fees) arising from or in connection with a Member's participation in the Programme, regardless of whether such loss or damage would arise in the ordinary course of events or otherwise, is reasonably foreseeable or otherwise, or is caused by any error or omission of Jumeirah, its affiliates, Partners or agents (whether negligent or not), except that nothing affects the liability of Jumeirah, its affiliates, Partners or agents for death or personal injury caused by their negligence or any other liability which may not be excluded or limited by law.

1.19. If any provision of these Terms and Conditions is deemed unlawful, void or for any other reason unenforceable, then that provision shall be deemed severed from the Terms and Conditions and shall not affect the validity and enforceability of any other provisions.

1.20. Jumeirah's failure to exercise or enforce any rights or provisions of the Terms and Conditions will not constitute a waiver of such rights or provisions. 

1.21. Nothing in these Terms and Conditions shall create a contractual relationship with, or cause of action in favour of, any third party. Any rights of any third party to enforce these Terms and Conditions under any applicable legal principle, statute or otherwise are excluded.

1.22. General words shall not be given a restrictive interpretation by reason of their being preceded or followed by words indicating a particular class of assets, matters or things.

1.23. The language of the Terms and Conditions shall be English and any and all communications relating thereto (including but not limited to any complaints or disputes), shall be conducted in the English language. 

1.24. These Terms and Conditions incorporate by reference the Programme Rules and any other terms and conditions appearing on the Website from time to time and represent the entire agreement between Jumeirah and Members in relation to the Jumeirah One Programme and supersede any previous agreement between them.  Each Member acknowledges that it is not relying on any representation, warranty or other statement relating to the Programme which is not set out in these Terms and Conditions. Members shall not be entitled to any remedies in respect of any representation, warranty or other statement (other than those set out in these Terms and Conditions) being false, inaccurate or incomplete unless it was made fraudulently.

1.25. By enroling into the Jumeirah One Programme, members consent to the programme’s Data Protection policy:  

For the purpose of applicable data protection laws, the data controller is Jumeirah International LLC ("us", "our", or "we") of PO Box 73137, Dubai, United Arab Emirates. If you use our facilities and services, the entity which manages the relevant facility or service (the "Country Manager") will also be a data controller in respect of your personal data as listed here https://www.jumeirah.com/en/jumeirah-group/terms-and-conditions/privacy--cookies-policy/

The information you provide to us (e.g. during your reservation, stay or visit to our facilities), or which we obtain from other sources (e.g. airlines, travel agents / tour operators) will be used by us in accordance with our Privacy Policy available at https://www.jumeirah.com/en/jumeirah-group/terms-and-conditions/privacy--cookies-policy/

We will use information that we hold about you for certain specified purposes, including providing you with services you request from us (e.g. spa / gym services, and hotel / restaurant bookings ); combining information we receive and collect to understand your interests and preferences and provide you with a more personalised experience; processing your payments; where applicable, managing your membership of the Jumeirah One programme and isme by Jumeirah programme (our recognition and rewards programmes); and providing you with information about our latest products and services and selected third parties, provided this is in line with your marketing choices.

We may share your personal information with members of the Jumeirah group, our service providers (e.g. for the purposes of providing concierge, housekeeping and laundry services), and our key partners (e.g. certain airlines and financial partners). Some of these third parties may be located outside the European Economic Area, in which case we will take all necessary steps to ensure that your information is treated securely and in accordance with our Privacy Policy, and that such transfers are permitted under applicable data protection laws.

2. Application for Membership

2.1. To apply for the Jumeirah One Membership, the Jumeirah One application form must be completed in full and either handed to a Jumeirah employee at a Jumeirah hotel, submitted on the Website or sent via post to the Jumeirah One Centre, PO Box 214159, Dubai, UAE.

2.2. All information required for Membership applications must be supplied accurately and in full. Jumeirah may reject any application if the required information is not supplied accurately and in full.

2.3. After the Member is successfully enrolled into the Jumeirah One Programme, an email will be sent to the Member confirming the same. The Member will be given a Jumeirah One Membership number and a link to the Website to activate their online account. The Member can then print their Jumeirah One Card from the website or download their e-card via a third party application.

2.4. Physical membership cards will not be issued to Blue Tier Members. Physical membership cards will only be issued to Active Silver and Gold Tier Members. 

2.5. When a Silver and Gold Tier Member requests a replacement card, their previous Jumeirah One Membership number will change and a new Membership number will be given to the Member, all Points collected under the old Membership number will be transferred to the new Membership number. The old Membership number will automatically be deactivated and the Member will not be able to use the old Membership number for any further transactions relating to collection of Points, Tiers, Rewards, use of Privileges and E-certificates or to gain access to the Website. It is the responsibility of the Member to ensure that they use their correct and valid Membership number for all Jumeirah One activity.  

2.6. Silver and Gold Tier Members may only request a replacement Jumeirah One Card once per calendar year. If a Silver and Gold Tier Member makes more than one request for a replacement Jumeirah One Card during that year, that Member will be charged in accordance with the Jumeirah One Programme. 

2.7. The Jumeirah One Card is non-transferable and may only be used by the Member whose signature is on it. The Jumeirah One Card can only be used by the Member and, without limitation, not by the Member’s relatives or friends. Members may be required to provide proof of identification at participating hotels (upon request by any Jumeirah employee) when collecting or exchanging Points and using any Privileges relating to the Jumeirah One Programme, in order for the Member’s identity to be established. If a Member fails to provide sufficient proof of their identity upon request, Jumeirah reserves the right to refuse to provide any Programme related services relating to that Member.

2.8. It is the sole responsibility of the Member to ensure that no person obtains unauthorised access to the Member’s Jumeirah One Card, Membership number or password. The Member shall be solely responsible for any activity linked to their Membership. Each issued Jumeirah One Card has an exclusive Membership number assigned to it.

2.9. Jumeirah One Membership is available only to individuals and not to companies, partnerships, associations, groups or other entities.

2.10. Jumeirah may refuse Membership without being required to give a reason for doing so.

2.11. Members must be eighteen (18) years of age or over.

2.12. A Member of the Jumeirah One Programme can only be issued with one Jumeirah One Card at any given time. Members shall not have multiple Memberships in the Jumeirah One Programme. Any multiple Memberships held by a Member will be cancelled automatically by Jumeirah without notice to the Member.

2.13. The Jumeirah One Card will not be issued to a person who is an employee of Jumeirah. Relatives of any such employees may not present a Jumeirah One Card when making use of any Jumeirah employee discount.

2.14. Membership and any application for Membership is void if prohibited by the applicable laws of the Member’s or applicant’s country of residence.

2.15. Any Member may terminate their Membership by submitting a written termination notice to the postal address shown in paragraph 1.9, signed by the Member, to Jumeirah. Membership will be terminated immediately upon receipt of such notice by Jumeirah.

2.16. Membership shall automatically terminate upon the death or bankruptcy of a Member. Jumeirah One Points accumulated prior to these circumstances will be immediately cancelled. Jumeirah may, acting in its sole discretion, re-instate all or a portion of any accumulated Jumeirah One Points in favour of the heirs of a deceased Member upon the application of his/her personal representative, provided that the deceased Member’s account holds a minimum balance of 15,000 Jumeirah One Points at the time of the Member’s death.

2.17. Jumeirah reserves the right to suspend or terminate the Membership of any Member, if that Member appears (in the sole discretion of Jumeirah) to be using the Programme in a manner inconsistent with these Terms and Conditions or intent of the Programme or any portion of the Programme, including, but not limited to, improper collection of Points or Tier Points or improper use of Privileges, Rewards or E-certificates. Jumeirah also reserves the right to terminate the Membership of any Member if there are reasonable grounds for suspecting (in the sole discretion of Jumeirah) that the Member has:

  • acted in a manner inconsistent with applicable local or federal laws or regulations;
  • breached or violated any of these Terms and Conditions;
  • engaged in any fraudulent or dishonest behaviour, theft, misconduct or wrongdoing in connection with the Programme
  • engaged in any abusive, fraudulent, disruptive, inappropriate, offensive or hostile conduct, whether it be physical, verbal or written in nature, towards any Jumeirah employee or guest;
  • failed to pay any bills or accounts due to Jumeirah or any hotel within the Jumeirah portfolio; or
  • attempted to collect Points or Tier Points relating to any spend not attributed to the Member.
  • Such terminated Membership may result in the loss of all accumulated Points and the cancellation of a Member’s Rewards, E-certificates, Privileges and the loss of any associated Tier status. In addition to the termination of such Membership, Jumeirah shall have the right to take such appropriate administrative and/or legal action as it deems fit against the Member, including, without limitation, criminal prosecution.

2.18. Each Member is responsible for remaining familiar to these Terms and Conditions and the number of Points and Tier status he or she has accumulated. Activity statements will be available to a Member via the Website as long as his or her Membership is Active. Activity statements will include information concerning Points, Tiers, Tier Points, Rewards, E-certificates.  

2.19. Jumeirah reserves the right at any time, in its sole discretion to deactivate Membership, in the event that a Member does not use the Membership for two (2) years. In such a case, a Member would be required to reapply to the Jumeirah One Programme as a new Member.
